Terms of Service

figtree is a product of Forgewell, LLC, 56 Broad St STE 14266, Boston, MA 02109. By creating an account, starting a trial, purchasing a subscription, or using figtree, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

You must be at least 18 years old and able to enter a binding agreement to create an account. You agree to provide accurate information, keep your credentials confidential, and promptly notify us of unauthorized use. You are responsible for activity under your account and for ensuring that anyone who uses it follows these Terms.

figtree helps customers record people, relationships, dates, places, and stories; build and view family trees; and use an AI family historian through text or voice. We may improve, add, remove, or limit features over time. Features may depend on third-party services and internet connectivity.

You retain ownership of the family information, stories, and other content you submit (“Customer Content”). You grant Forgewell a limited, worldwide, non-exclusive license to host, copy, process, transmit, display, and modify Customer Content only as needed to operate, secure, support, and improve figtree.

You represent that you have the rights and permissions needed to submit Customer Content. You are responsible for its accuracy and for respecting the privacy, publicity, confidentiality, and intellectual-property rights of living relatives and other people.

AI-generated responses and suggested tree changes may be incomplete, inaccurate, or inappropriate. They are organizational aids, not authoritative genealogical records, legal advice, or professional research. You are responsible for reviewing outputs and confirming facts and relationships. Do not use figtree to impersonate a person, fabricate evidence, or create deceptive audio or family records.

You may not use figtree unlawfully; violate another person's rights or privacy; upload malicious code; harass, exploit, or endanger others; probe or bypass security or account limits; scrape or reverse engineer the service except where law expressly permits; interfere with service operation; use automated access without written permission; resell the service; or use the service or its outputs to develop a competing model or product.

Plan features, trial periods, and prices are shown at checkout or on the pricing page. If you purchase a subscription, you authorize Stripe to charge the applicable recurring fees and taxes to your payment method until cancellation. Subscriptions renew automatically for the stated billing period unless canceled before renewal.

You may cancel using available account controls or by contacting legal@usefigtree.com. Cancellation stops future renewal but does not generally provide a refund or credit for the current billing period. Fees are non-refundable except where required by law or where Forgewell determines that a duplicate charge, billing error, or material service failure warrants a refund. We may change prices with advance notice applicable to a future renewal.

figtree, its software, visual design, branding, and other service materials are owned by Forgewell or its licensors and are protected by intellectual-property laws. Except for the limited right to use the service under these Terms, no rights are transferred to you. Feedback may be used without restriction or compensation.

figtree relies on services such as OpenAI and Stripe. Their availability, outputs, and processing are outside Forgewell's direct control and may be governed by separate terms. Forgewell is not responsible for third-party services, but will use them only as reasonably needed to provide figtree.

You may stop using figtree at any time and may delete your account from Settings. We may suspend or terminate access for nonpayment, material or repeated violations of these Terms, security risk, unlawful activity, or when necessary to protect the service or others. Where practical, we will provide notice and an opportunity to resolve the issue. Provisions that by their nature should survive termination will survive.

To the fullest extent permitted by law, figtree is provided “as is” and “as available.” Forgewell disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise that the service will be uninterrupted, error-free, or that family-history information or AI output will be accurate. Nothing in these Terms limits warranties that cannot legally be disclaimed.

To the fullest extent permitted by law, Forgewell and its members, employees, agents, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities. Forgewell's total liability arising from figtree or these Terms will not exceed the greater of $100 or the amount you paid Forgewell for figtree during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-laws principles. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Suffolk County, Massachusetts, and each party consents to their jurisdiction, except where applicable consumer law gives you the right to bring a claim elsewhere.

We may update these Terms as figtree changes. We will post updated Terms and revise the “Last updated” date, and will provide additional notice of material changes when required. If any provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement regarding figtree unless you and Forgewell sign a separate agreement.
